This article analyses feminist discourses on the criminalisation of violence against women in Ecuador, after the enactment of a “post-neoliberal” constitution. It responds to arguments in feminist legal theory, which affirm that penal expansion thrives through neoliberal globalisation, and that certain feminists have sponsored this carceral-neoliberal alliance, over and above redistributive concerns. However, in Ecuador, many feminists who participated in a recent criminalisation process also endorsed the post-neoliberal government’s social redistribution programme. Ecuadorian feminism therefore complicates current discussions on carceral and (...) governance feminism, which link penal expansion with neoliberalism and an absence of redistributive concerns. Ecuadorian left-leaning feminists use rights-based frameworks to reconcile penal interventions with potential abuses of coercive power. This allows them to regard criminal justice as minimally problematic within the redistributive agenda they endorse. At the same time, the penal approach of Ecuadorian feminists runs the danger of marginalising legally pluralistic approaches to justice. (shrink)

This article asks if the incorporation of Sumak Kawsay, a concept from Andean philosophy, into the Constitution of Ecuador, has impacted the legal regulation of violence against women. It examines the trajectory of penal reform in the field of domestic violence and suggests that the decolonial shift in the Constitution has failed to significantly disrupt the dominant framework of penality in which gender violence regulation is inscribed. At the same time, feminist demands have been reframed through the formations of criminal (...) law and the dominant political discourse, resulting in provisions that reproduce a positivistic logic and a family protection rationality, with problematic consequences for women’s access to justice on the ground. If securing success in legal reform entails translating emancipatory demands into established and unchallenged penal paradigms, the potential of decolonial notions is overshadowed by the language, formalities and underlying assumptions of criminal law. Despite the persistence of violence inside and around prisons, and the dubious adequacy of criminal law to respond to victim–survivors, international human rights (IHR) discourse increasingly promotes the mobilisation of the state’s penal apparatus to respond to human rights violations, including violence against women (VAW). Using an anticolonial feminist approach, this article scrutinises the ontological and epistemological commitments underlying ‘human rights penality,’ by analysing features of the Western-colonial register vis-a-vis more relational worldviews. Separateness, abstraction, and transcendence broadly underpin the exclusion (...) of embodied experience, context, and material reality from the juridical field. In the second part, through discourse analysis of Inter-American and European case law, the author shows the deployment of human rights penality, the displacement of experience, and the disregard of context in IHR discourse. VAW is construed as a procedural and penal matter: it is the absence of a penal process that courts regard as failure to protect women, rather than the state’s inability/unwillingness to address structural subordination. Moreover, the ‘virtues’ attributed to the penal system justify its expansion, which facilitates the continuity of penal violence and debilitates alternative approaches to justice. Finally, the author posits penal abolition as an anticolonial praxis, pointing at examples of anti-carceral feminist work. (shrink)

El artículo propone un diálogo Sur-Sur acerca de los desafíos que plantea el campo político en la actualidad. Además de las coordinadoras Joice Barbosa y Moira Pérez, participan Silvina Tapia Tapia de Ecuador, Abdourahmane Seck de Senegal y Verónica Figueroa Huencho de Wellmapu, quienes se desempeñan tanto en el ámbito académico como en el campo social mediante el activismo político y/o comunitario, desde el cual producen conocimientos colectivos de carácter situado. A lo largo de la conversación se analizan (...) temas tales como la expresión de formas contemporáneas de neoconservadurismo y autoritarismo, las disputas de los movimientos sociales con la institucionalidad, sus tensiones con un Estado que tiende a la cooptación pero también mantiene profundas lealtades capitalistas y coloniales, y las posibilidades y experiencias de formas alternativas de organización colectiva y comunitaria. Electoral debates are a win-lose game in which the stakes for the political contenders are extremely high. The antagonistic nature of these encounters very frequently results in impoliteness or face aggravating moves with which the debaters aim to hurt the opponent’s positive or negative face.The aim of this research is to investigate the impoliteness strategies employed by politicians during electoral debates. Garcia-Pastor’s (2008) positive-face and negative-face impoliteness strategies are taken as a starting point in the analysis at hand. The final (...) electoral debate of the 2019 presidential elections in the Republic of North Macedonia is used as a data source for this research, which is based on several different hypotheses and is both qualitatively and quantitative oriented. The findings of the research are in line with the insights gained from previous studies, which, more or less, suggests that Macedonian politicians follow the mainstream “rules” when it comes to using impoliteness in political debates. Silvana Greco propone, per la prima volta, un’analisi approfondita della Philosophie sociale, pubblicata a Parigi alla fine del giugno 1793 da Moses Dobruska (1753- 1794), uomo d’affari, letterato e filosofo sociale. Nato in Moravia da una famiglia ebraica, affiliata alla setta ereticale dei sabbatiani, Dobruska si convertì in giovane età al cattolicesimo, compì una notevole ascesa sociale alla corte asburgica di Vienna ed emigrò poi in Francia, per aderire alla Rivoluzione. Durante il soggiorno parigino prese il nome di Junius (...) Frey, fu assai attivo tra le fila dei giacobini ma riuscì a sopravvivere solo di poco alla propria Philosophie. Accusato di cospirare per conto di potenze straniere, fu ghigliottinato il 5 aprile 1794, al culmine del Terrore, nello stesso giorno in cui anche Georges Jacques Danton saliva sulla forca. Quando apparve, la Philosophie sociale suscitò un notevole interesse, tanto da venir apprezzata nientemeno che da Immanuel Kant. Greco mostra come il lavoro di Dobruska abbia avuto anche altri lettori celebri, che per vari motivi omisero di menzionare, tra le loro fonti, un outsider di dubbia reputazione, su cui pesava una condanna tanto ingiusta quanto infamante. Dalla Philosophie sociale derivano alcuni concetti chiave delle discipline sociali, come le conosciamo oggi. Iniziatore entusiasta e sfortunato, talvolta brillante teorico, Moses Dobruska merita un ruolo a sé nella storia del pensiero sociologico. (shrink)

The paper offers a critical discursive and pragmatic analysis of a corpus of hateful Facebook and Twitters status updates of politicians, political activists and voters in the 2016 pre-and-post election period, in Macedonia. Aiming to determine how power is exerted on social media, the paper focuses on identifying the stance social media users take when posting messages with political content. The analysis first attempted to unveil what speech acts the hateful posts are predominantly composed of, what roles the authors of (...) the posts normally assume, who the hateful political discourse in the given socio-political context is directed to, as well as what are some of the predominant linguistic strategies underlying the analysed hateful comments. The results show that, by using mostly assertive and expressive speech acts, social media users assume mainly the roles of analysts and judges and only subsequently the one of activists, they mostly address politicians directly and they use a lot of negative lexis, rhetorical figures and boosters as interpersonal metadiscourse markers to express their negative stance and exert power and dominance. The research is developed with the use of deductive and descriptive analytical methods used to obtain information on doctrine and jurisprudence and to establish and describe specific situations in the field of Ecuadorian Medical Law respectively. The main objective is to provide scientific and doctrinal tools to understand guilt in cases of omissive conduct in Ecuadorian medical practice, as well as its comparison with other countries such as Colombia, Mexico, Cuba and Argentina, the results of the research show that the (...) doctrine in the relationship to the categories of Omission, Guilt, Guarantor Position and Permitted Risk is broad and is based on scientific-doctrinal advances of the Normative Conception of Guilt comprised between 1995 and 2022. To establish useful criteria and conclusions, the discussion focuses on defining what is considered “guilty” in the context of Medical Law, highlighting the importance of elements such as the objective duty, the harmful result and the analysis of the concomitant circumstances, emphasizing the importance of considering the context and development of the facts in cases of omissive conduct in medicine and not only the result. In relation to omissions in criminal law, a distinction is made between proper and improper and finally, it concludes by suggesting the modification of article 146 of the Organic Integral Criminal Code to guarantee due process and a effective judicial protection in matters related to health in Ecuador, specifically with regard to causality in cases of omissive conduct. No presente artigo, eu gostaria de circunscrever um campo de pesquisa, pertinente à filosofia contemporânea, que poderia ser explorado pela fenomenologia. Mais especificamente, partindo das objeções que Merleau-Ponty endereçou a Husserl, desde a publicação da Fenomenologia da Percepção, quando o filósofo francês mostrou quais são os limites da redução transcendental, pretendo discutir em que sentido seria possível utilizar ferramentas metodológicas da fenomenologia merleau-pontiana para descrever a experiência concreta na Modernidade.

En esta investigación se estudia el género reclamo con el propósito de describir su arquitectura discursiva. A partir de la revisión de 100 reclamos chilenos y sobre la base del análisis de los mecanismos de textualización utilizados, se propone una estructuración de las fases discursivas que configuran la superestructura textual en estudio. Además, se describen los recursos lingüísticos característicos de la construcción de dicho género. Se trabaja con dos teorías: la de género discursivo y la de esquemas textuales. Los resultados (...) del estudio indican que los reclamos de los chilenos se configuran en secuencias narrativas, descriptivas y argumentativas, que presentan por lo menos ocho fases bien definidas y que se caracterizan por la inclusión de recursos lingüísticos como los marcadores de opinión y probabilidad, los pronombres personales, el presente narrativo, adverbios, adjetivos y citas directas. De acuerdo con estos resultados, podemos concluir que existen ciertos tipos temáticos y estructurales que configuran el género reclamo en los hablantes chilenos. (shrink)

Resumen En esta investigación se presentan los resultados del estudio de las funciones pragmático-discursivas desempeñadas por oraciones escindidas del tipo “lo que pasa es que” en narraciones conversacionales de experiencia personal generadas por hablantes chilenos. Se analizan 54 narraciones conversacionales con dos propósitos: clasificar las oraciones escindidas según la parte de la estructura narrativa que introducen y ofrecer una taxonomía de funciones pragmático-discursivas que desempeñan dichas construcciones. Entre las principales conclusiones se destaca que las oraciones escindidas desempeñan tres macro-funciones: focalizadora (...) –aparentemente la más relevante para la cadena narrativa–, introductora de atenuaciones justificantes y orientadora, cada una con diferentes posibilidades de realización. This paper suggests an approach to the various possibilities of reading as a practice responsible for generating thought. It might be said that it is an approach to the dismissal of reading as the origin of other paths of thought. Utopia, understood as anticipation, yields its place to the figure of redemption (in Benjamin’s sense of the word) as imminence of the absolutely other, expectation and extreme attention. The text invites the reader to try other routes in the practice of (...) reading (other than solitary silent reading), in which the body and the senses play a part, and - especially - the other, to allow the advent of a thinking that welcomes justice. A modified flanker task was used to assess the effects of spatial attention during conscious and nonconscious processing. In line with prior findings, we demonstrated that increasing spatial separation between flankers and probes diminished the differences between reaction times to the incongruent and congruent probe–flanker pairs. This trend occurred even when the identity of flankers was suppressed from awareness by a metacontrast mask, indicating that spatial attention can be allocated to information processed at the nonconscious, in addition to the conscious, (...) levels, that effects of spatial attention at these two levels can be equivalent, and that attention deployed at the nonconscious level of processing can be characterized by a spatial gradient that is nearly identical to that found at the conscious level of processing. In Brazil, every study involving human beings is required to produce an informed consent form that must be signed by study participants: this is stated in Resolution 196/96. 1 Consent must be obtained through a specific structured process. Objective: To present the opinions of women regarding how the process of obtaining informed consent should be conducted when women are invited to participate in studies on contraceptive methods. Subjects and Methods: Eight focus groups were conducted, involving a total of 51 women (...) living in the metropolitan region of Campinas. The women involved in the study were either participating in a clinical trial in the area of women's health or had participated in such a trial in the previous 12 months. A thematic guide was used to conduct the focus group discussions; the discussions were recorded, transcribed and a thematic analysis performed. Results: In general, the person who invites a woman to participate in a study should be a member of the research team but not the principal investigator. Information relating to the study should be given orally and in writing, both individually and in the group setting. Study volunteers should be informed about, among other things, the risks, possible side effects and discomforts, including long-term effects. The use of audiovisual aids to provide information was suggested. Conclusion: The process for obtaining informed consent was seen as a means of establishing a relationship between the volunteers and the investigator/research team. The information that the study participants expected to be given coincides with the requirements established under Resolution 196/96. The use of audiovisual aids would improve understanding of the information provided. (shrink)

El debate como método para mejorar la expresión y comprensión oral en Educación Primaria se está viendo reforzado por las últimas legislaciones educativas, como la LOMLOE, que da muchísima importancia al desarrollo de competencias y habilidades. En este proyecto de intervención educativa se pretende despertar el interés de los alumnos por nuevos temas de debate, incrementando su capacidad de razonamiento y análisis, habituándolos a recibir críticas y desarrollando aptitudes comunicativas. Over the last few years, there has been an exaggeratedly widespread and frequently confused use of the concepts of 'stakeholder' and 'corporate social responsibility'. However, some interesting insights of both these notions can be found in traditional European business administration studies. In this article, the Italian view will be examined. In particular, this paper investigates the teachings of some of the historical masters of the Italian "Economia Aziendale", with particular attention to the concept of the azienda, its finalism and its (...) essential characteristics, in order to verify some consistencies with the more recent Stakeholder Management Theory. Principles and considerations seem to emerge from EA scholars' seminal works that unequivocally connect ethics with business decisions. EA fits in with SMT in many ways, and the former seems, moreover, to suggest a specific normative point of view from which the role of ethics in business activities can be approached. (shrink)

This paper studies the processes of historical social construction of “indigenous intellectuals”, one of the most important and complex stages for ethnic movements in Latin America: redemocratization, the opening of markets and high participation of the grassroots mobilization processes. Thus, this proposition develops a two-point analysis: firstly, the definition and selfdefinition which is made by an indigenous intellectual and, on the other hand, the problems facing this etnointellectual in a scientific and Western semantic framework. The programme PIBID-EA intends to closer licensees of undergraduate teaching courses with the reality of public schools. By promoting the teacher-researcher training on the basis of implementing collaborative actions between universities and partner schools it aims at encouraging critical questioning of environmental issues, providing appropriate conditions for PIBID-EA-grant fellows initiate school teaching. University lecturers, elementary school supervisors and the school community collaborate in partnership to improve knowledge and develop values and skills for students acting in favour of sustainable society, where (...) Environmental Education is one of the main issues. The partnership acts collectively in the school field, establishing interfaces with social and environmental issues as follows: didactic monitoring, study of the environment and action research. From the interfaces of these actions, three priority axes were elected for the development of socio-environmental activities. Firstly, the “Consolidation of the Committee on Environment and Quality of Life in School”; The second priority axis is the“Construction of Agenda 21 at School”inally, the third axis is the “Youth in Action Project.”. Será tarea del pensamiento crítico recuperar la imagen para un discurso de la resistencia como un discurso efectivo frente a la inoperancia del objeto artístico difuso. A esto debe convocar al análisis crítico de la imagen hegemonizada por la superficie-referente. La radicalidad de dicha tarea debe buscar sus fuentes en el desplazamiento constante hacia la descripción de lo opaco en la estrategia representacional de una superficie-referente para la instalación del objeto fascista estetizante. Dicha radicalidad debe recuperar conceptualmente el desmantelamiento crítico (...) para la reapropiación de la imagen, de lo visual; debe desactivar la radicalidad de lo espectacular. Este análisis de la superficie-referente en la retórica radical del objeto fascista representacional es la tarea necesaria para situar adecuadamente una crítica que se distancie de dicha retórica que no hace más que tornar al objeto representado en un objeto estetizante y fascista en su exceso de real. La resistencia debe centrarse en el análisis permanente de una imagen en constante readecuación al interior de la lógica global del capitalismo. Cualquier nueva articulación de las humanidades debe atender, primero que nada, a la pregunta por cuál es el estatuto de lo visual en dicha lógica antes de emprender cualquier definición de cómo se deben conformar los discursos de resistencia. Es tarea e intento de este trabajo situar la descripción de las estrategias de la imagen en tiempos de su hiper- reproductibilidad- técnica antes de cualquier replanteamiento de las humanidades, esto para comprender cuáles son propiamente las retóricas de lo radical en el capitalismo cultural. Meiner nichtreduktionistischen Lesart Gadamers, derzufolge eine wechselseitige konstitutive Relation zwischen "Sprache" und "Erfahrung" besteht, ist es gestattet, den Vorwurf, die Sprachphilosophie Gadamers führe in den Relativismus, den man häufig gegenüber sprachphilosophischen Positionen erhebt, abzuweisen. Manchen Denkern zufolge haben die Philosophen der Postmoderne, zu denen auch Gadamer gezählt wurde, eine einfache Umkehrung der beiden Pole des modernen Verhältnisses "Sprache"--"Erfahrung" vollzogen: Während die Sprache in der Moderne in ihrer Bedingtheit zur Erfahrung und als bloßes Ausdrucksmittel verstanden wurde, wurde dieses Verhältnis in der (...) neueren Philosophie nur umgekehrt, insofern die Philosophie in der Sprache das Fundament für die Erfahrung sehe, wonach die Erfahrung als ein Ausdruck der Sprache erscheine. Die vorliegende Arbeit setzt sich mit diesem Relativismusvorwurf auseinander und beabsichtigt, eine wechselseitige Abhängigkeit zwischen Sprache und Erfahrung ausgehend von Hans-Georg Gadamers Werk zu entwickeln. Um das zu erreichen, wurden zunächst eine doppelte negative-positive Erfahrungsstruktur und dann einige phänomenologische und transzendentale Merkmale der Erfahrung auf dem historischen Hintergrund für Gadamers Erfahrungsbegriff herausgearbeitet. Somit machte sich die konstitutive Sprachlichkeit der Erfahrung erkennbar. In einer Auseinandersetzung mit dem Sprachbegriff auf der anderen Seite wurde sein dialogischer und welterschließender Charakter veranschaulicht, so dass auch seine Angewiesenheit auf die Welterfahrung offenkundig wurde. In the nineteenth-century Ottoman empire, Cappadocia, in the heart of Anatolia, was one of the last regions where Rum Orthodox Christians cohabited with Muslims in rural areas. Among the main aspects of everyday coexistence were the beliefs and ritual practices that, shared by Muslim and Christian individuals, blurred religious belonging as it is traditionally defined. Anthropologists and ethnologists have studied exopraxis broadly, while historians have neglected the topic until recently. In the case of anthropologists, studies have mostly focused on the (...) spatiality of sharing that is characteristic of exopraxis. This article, based largely on testimonies collected in the Oral Tradition Archives of the Center for Asia Minor Studies in Athens, analyzes the temporality of exopraxis and inquires into the different but shared calendars that ordered the ritual life of Muslims and Orthodox Christians in Cappadocia. These testimonies, taken from Orthodox Christians who lived in Turkey prior to the exchange of populations between Turkey and Greece in 1923, help us to understand how the sharing of religious calendars resulted in feelings of belonging to a single collectivity. La filière migratoire comme la migration internationale font jouer des traits culturels communs qui rapprochent les migrants et leur permettent de participer à la même économie collective. Le gouvernement essaie de les contrôler politiquement et religieusement, mais la plus grande formation (...) intellectuelle des opposants leur donne un fort ascendant. Este artículo analiza la novela Dos veces junio (2002) de Martín Kohan desde la teoría de los afectos. El narrador de Dos veces junio se caracteriza por la ausencia, la suspensión, la vacilación o la supresión de afectos. Asumiendo que las respuestas afectivas corresponden necesariamente al momento histórico y a la esfera de la cual emergen, el artículo explora esta desafección como un componente esencial del funcionamiento del régimen autoritario que la novela retrata. Así, se sostiene que el afecto es (...) no solo esencial para iluminar una época histórica sino la manera en que el pasado pervive en el presente ya que las inscripciones afectivas son las depositarias del sentido más oculto –y más original– de la memoria. According to most academics, different generations share common characteristics. This undoubtedly helps to better understand their behavior in different scenarios, predicting their responses. However, this seems questionable and that is the main purpose of this study. This research, although preliminary, try to confirm if millennials have common characteristics, or if, on the contrary, there are differences between them due to the culture in which they are immersed. To this end, it has been contextualized in a sector that is very sensitive (...) to cultural differences, such as tourism. Data collection was carried out through a questionnaire administered in 2019 via e-mail to young South Korean and Spanish millennials. The results suggest that there do not appear to be common personality traits between the countries analyzed. The differences between the two groups for most personality traits and travel motivations were significant. The findings of this research provide several practical implications since it will make possible a more appropriate management of the tourist destination. (shrink)

O artigo investiga a passagem da natureza à cultura através do conceito de vida, tendo como base as formulações de Bergson, Canguilhem e Merleau-Ponty. Para tanto, é necessário investigar a gênese dos modos de subjetivação – a ação vital, a normatividade do organismo e o caráter expressivo da vida – proposta por cada um dos autores de modo que possamos refletir até que ponto se pode explicar a ordem humana a partir de sua vinculação à natureza.

If it is true that semiotics has tried to establish itself as an autonomous science starting with Saussure and Peirce, in imposing itself as a cultural fashion since the 1960’s, due especially to Roland Barthes and his interest in the language of connotations, it is also true that from ancient treatises of medicine to books of magic, from rhetoric to logic, from nature to science, symbols— even from different points of view—have been the object of passionate reflections.

El artículo analiza la noción de amor en la filosofía de Spinoza a través del Tratado de la reforma del entendimiento, el Tratado breve y la Ética. El amor en Spinoza debe contextualizarse en su fenomenología crítica de los afectos y su teoría del conocimiento. Así es posible mostrar que, para Spinoza, cómo se ama —activa o pasivamente— es más importante que una distinción normativa entre objetos de amor correctos o incorrectos. Over the last few years, there has been an exaggeratedly widespread and frequently confused use of the concepts of 'stakeholder' and 'corporate social responsibility'. However, some interesting insights of both these notions can be found in traditional European business administration studies. In this article, the Italian view will be examined. In particular, this paper investigates the teachings of some of the historical masters of the Italian "Economia Aziendale" (EA), with particular attention to the concept of the azienda, its finalism and (...) its essential characteristics, in order to verify some consistencies with the more recent Stakeholder Management Theory (SMT). Principles and considerations seem to emerge from EA scholars' seminal works that unequivocally connect ethics with business decisions. EA fits in with SMT in many ways, and the former (EA) seems, moreover, to suggest a specific normative point of view from which the role of ethics in business activities can be approached. (shrink)

The paper builds on the stakeholder salience framework and applies a social identity approach to explain family firm dynamics and how these could impact on family firm governance and ethics. In particular, we consider the family as the main stakeholder for family firms and we refer to the recent approaches to stakeholder theory based on ‘names-and-faces’ and on social identity to focus on family members at the individual and organizational level. Family businesses offer an opportunity to study stakeholder salience in (...) settings with multiple logics. Our paper acknowledges how the attributes of legitimacy, power and status, for family business members, can derive from three different institutional settings (family, business and local community) and how these attributes are assigned and gained by family members on the basis of the stakes they put (or could put) on the business. From the analysis of these dynamics specific ethical considerations emerge. (shrink)

Desde una respuesta tentativa a la pregunta qué es una imagen se busca establecer el modo en que pensamos en, con y contra las imágenes. Se concentra la indagación en dos tipos particulares de imágenes, las generadas por el aparato digital, con el fin de articular conceptualmente el modo en que las imágenes cobran sentido y cómo dicho sentido surge desde el estatuto ontológico que encierra dicho aparato en particular. Desde una respuesta operativa y desde el concepto de modo de (...) imaginar se propone que el modo de pensar en, con y contra las imágenes es una disputa política por controlar el modo de aparecer en las imágenes, es decir, por el control del plano estético y ontológico que encierra dicho aparecer. Dicha disputa política en el aparato digital se instala contemporáneamente en torno al objeto fascista de la representación. (shrink)

El debate actual en torno al transhumanismo hace pertinente tener en cuenta el pensamiento de Foucault. Tras la crítica al humanismo moderno, el último Foucault da pie para pensar un «humanismo otro» al servicio de esa «vida otra» que por razón de dignidad y anhelos de autorrealización la filosofía propone como tarea suya irrenunciable. El coraje o audacia para la verdad, pieza clave en su concepción de una «filosofía militante», permite a su vez replantear la tarea de la crítica en (...) la opinión pública de una cultura digital, teniendo en cuenta posibilidades y riesgos de la civilización tecnológica en la época del «big data» y la inteligencia artificial.
